What is the difference between General (GPA) and Special (SPA) POA?
GPA grants broad powers to the attorney, such as managing bank accounts, renting out property, paying bills, and initiating litigation. SPA is narrow and restricted to a single specific transaction, like registering a sale deed or appearing before a registrar for one specific property.
How does an NRI register a POA in Maharashtra?
The NRI principal signs the POA document and gets it notarized or certified by the Indian Consulate in their country of residence. They send the original physical document to India, where the attorney must get it "adjudicated" (stamped with local stamp duty) within three months at the local district registrar office.
Is registration of Power of Attorney mandatory?
Yes, if the POA involves authorizing the sale, transfer, or registration of immovable property, it must be officially registered at the Sub-Registrar office to be legally accepted.
