What is Offline Leave & License Registration?

Offline Leave & License registration refers to the traditional method of registering a rent agreement by physically appearing at the Sub-Registrar's Office. Both the Licensor (landlord) and the Licensee (tenant) must be present in person (or through Power of Attorney) along with two witnesses.

Under the Maharashtra Rent Control Act, 1999, registration of Leave & License agreements is mandatory for periods exceeding 11 months, and even for shorter periods it is strongly recommended for legal protection.

Who Needs Offline Registration?

  • Parties whose Aadhaar is not linked to an active mobile number
  • NRIs (Non-Resident Indians) who wish to register through a Power of Attorney holder
  • Cases where the online e-signing system has technical issues
  • Individuals who prefer or are more comfortable with traditional methods
  • Situations requiring additional witnesses or special notarial formalities

Documents Required for Offline L&L Registration

From Licensor (Landlord):

  • Original property documents (Index II, Property Card or 7/12 Extract)
  • Aadhaar Card and PAN Card (original + 2 copies)
  • Passport-size photographs (4 copies)
  • Society NOC / Share Certificate (for society flats)

From Licensee (Tenant):

  • Aadhaar Card and PAN Card (original + 2 copies)
  • Passport-size photographs (4 copies)
  • Employee ID card or other proof (optional but helpful)

Documents Required from Both Witnesses:

  • Aadhaar Card or any valid government photo ID
  • Passport-size photograph (1 each)

Stamp Duty Calculation for Leave & License in Maharashtra

Stamp duty is calculated based on the monthly rent and the duration of the agreement:

  • Formula: 0.25% × (Total Rent for the period + Security Deposit)
  • Minimum stamp duty: ₹100
  • Registration fee: Flat ₹1,000 for agreements up to 11 months
